Terms and conditions
Overview
These Terms and Conditions govern your use of awakenwithvictoriabond.com (the “Site”) and any programmes, products, memberships, and services offered through it (the “Services”). The Site is operated by Victoria Bond Ltd, a company based in New Zealand, trading as Awaken with Victoria Bond (“we”, “us”, “our”). The terms “you” and “your” refer to visitors, customers, members, and students.
Our Services include spiritual development and mediumship education: free resources, videos, and the Million Dollar Medium podcast; digital courses such as the 12 Steps to Mediumship Mastery; The Spiritual Membership subscription; the Magnificent Mediumship live certification programme; and related coaching, calls, and community spaces.
By using the Site, or by purchasing or enrolling in any Service, you agree to these Terms and Conditions. If services have commenced without a separately signed agreement, these Terms and Conditions apply and are binding.
Important Disclaimers
Our work is spiritual and personal development education. It is offered in good faith, and it asks something of you. Your own practice, participation, and discernment. Please read the following carefully:
- Not professional advice. Nothing on the Site or in any Service is medical, psychological, psychiatric, financial, legal, or other professional advice, and it is not a substitute for care from a qualified professional. If you are experiencing a health or mental-health issue, please seek help from an appropriate practitioner.
- No guaranteed outcomes. Spiritual and intuitive development is personal. We do not guarantee any particular experience, ability, result, or income. Testimonials and examples on the Site (including references to what graduates charge for readings) reflect individual experiences and are not a promise of what you will achieve.
- Certification. Completion of Magnificent Mediumship results in certification within the Awaken lineage. It is a private certificate issued by us; it is not a government-accredited or NZQA-registered qualification.
- Your responsibility. You are responsible for your own decisions, actions, and results, including any choices you make about offering paid services to others after completing our programmes.
- Your wellbeing. Spiritual work can bring up strong emotions. By enrolling in a programme you confirm that you are able to participate in group and one-to-one spiritual work, that you will care for your own physical and mental wellbeing during it, and that you will seek support from a qualified health professional if you need it. Our team are not crisis or mental-health practitioners. If you are in crisis, please contact your local emergency or mental-health services.
Use of the Site and Services
You must be at least 18 years of age to use the Site or purchase any Service. You agree to use the Site for lawful purposes only, and not to post or transmit material that infringes the rights of others or is threatening, abusive, defamatory, obscene, or otherwise objectionable. Content on the Site may change at any time; while we work to keep it accurate, we do not warrant that all content is complete, current, or error-free.
We may refuse or cancel any order at our discretion. No order is accepted until payment has been processed. We may change or discontinue any aspect of the Site or Services, subject to fulfilling responsibilities we have already accepted payment for.
Accounts
Some Services require an account. You agree that the registration information you provide is accurate and kept up to date, that you will not impersonate anyone else, and that you are responsible for keeping your login details secure. Accounts and course access are personal to you and must not be shared or resold.
Purchases, Pricing and Currency
Prices are displayed on the relevant offer page and, unless stated otherwise, are in US dollars (USD). You are financially responsible for all purchases made through your account. Payments are processed securely by our payment providers via the Kajabi platform; we do not store your full card details.
We try to describe every Service accurately. Where a genuine pricing or description error occurs, we may correct it and reserve the right to cancel an order placed at an incorrect price, with a full refund of that order.
After purchase you will receive a confirmation email with access or delivery details. If anything in your confirmation looks wrong, please tell us as soon as possible.
Payment Plans
Some programmes (for example, Magnificent Mediumship) can be paid by instalments. A payment plan is a convenience for paying the full programme price over time. It is not a subscription you can end early. By choosing a payment plan you commit to the total programme price, and you authorise us to charge each instalment to your nominated card when it falls due, without separate authorisation for each charge. Your obligation to complete the instalments continues even if you stop participating in the programme.
Enrolment on a payment plan includes signing our Payment Plan Agreement, which sets out your instalment schedule, contact details, and these terms. We may withhold programme access until the signed agreement is returned. If services have commenced before the agreement is signed, these Terms and Conditions apply in full.
If a payment is missed, the following applies automatically:
- Days 1 to 3: your card is retried automatically and we email you. A payment that clears within this 3-day grace period incurs no fee.
- Day 4: a late-payment administration fee of USD $50 is added to the overdue instalment.
- Day 7: your access to the programme, portal, and community is paused until your account is brought up to date. Missed live calls are not rescheduled or refunded.
- Day 30: the full remaining balance of the programme becomes immediately due and payable, and we may refer the account for collection. Reasonable collection and recovery costs are added to the amount owed.
Certification is issued when your three months are complete, whether you paid in full or are on a payment plan. On a payment plan, the remaining instalments continue as scheduled after certification.
If you know a payment is going to be difficult, email [email protected] before it falls due. We are far more able to help before a payment is missed than after.
Membership Subscriptions
The Spiritual Membership is a recurring subscription billed at the price and interval shown at checkout (currently monthly or annual). Your subscription renews automatically until you cancel. You can cancel at any time from your account or by contacting us; cancellation takes effect at the end of your current billing period, and you keep access until then. There are no lock-in contracts and no cancellation fees. Amounts already billed for the current period are not refunded.
We may change membership pricing or inclusions from time to time; we will give existing members reasonable advance notice of any price change before it takes effect.
Cancellations, Refunds and Chargebacks
Because our products are digital and access is delivered immediately, and live programmes are delivered in real time, we do not offer refunds for change of mind on digital products, programmes, or membership periods already billed. Please choose carefully, and use the free resources, Your Gift Quiz, or a Coffee Date call to make sure a programme is right for you before enrolling.
Your consumer rights. Nothing in these Terms and Conditions limits any rights or remedies you may have under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any consumer protection law in your country of residence that applies to you and cannot be excluded. If a Service fails to meet a guarantee under applicable consumer law, you are entitled to the remedies that law provides.
If you are acquiring a Service for the purposes of a business, you agree that the Consumer Guarantees Act 1993 does not apply.
Where we choose, in a particular case, to offer a refund, credit, or other goodwill gesture beyond what these terms or the law require, that is a discretionary decision made on the facts of that case. It does not change these terms and does not create an entitlement for any other person or purchase.
Chargebacks. If you believe a charge is incorrect, please contact us first so we can put it right. Most issues are resolved quickly. If a chargeback is raised on a valid charge without first giving us a reasonable opportunity to resolve it, we may suspend access to your Services while the dispute is open, recover reasonable costs we incur responding to it, and decline future orders from you.
Community, Live Calls and Recordings
Our programmes include live calls and community spaces. These are held as safe, respectful rooms for real spiritual work. You agree to treat other members with respect and confidentiality. What is shared by others in the room stays in the room. You also agree not to solicit other members or disrupt sessions. We may remove anyone from a community or live call, or from a programme, for behaviour that harms the group, without refund of amounts already due.
Live calls may be recorded and made available as replays to programme participants. By taking part with your camera, microphone, or chat, you consent to being included in those recordings. If you would prefer not to appear, you can keep your camera off and ask questions privately.
If you share feedback or a testimonial with us, we will only use your words and name in marketing with your permission.
Client Conduct and Our Right to Withdraw
We hold our spaces with care, and we expect the same in return. You agree not to harass, threaten, abuse, or deceive Victoria, our team, or other members, whether in our communities, on calls, by email or message, or on social media. You also agree not to make statements about us that you know to be false or misleading. Nothing in this section limits your right to share honest opinions, reviews, or lawful complaints.
If your conduct seriously breaches these terms, endangers or harms others, or makes it untenable to continue working with you, we may suspend or end your participation in a Service. Where we end participation for serious misconduct, amounts already paid or due for that Service are not refunded. Separately, if we form the view that a Service is not the right fit for you, we may withdraw it at our discretion and refund the unused portion of what you have paid. That choice is ours to make and is a complete remedy for the withdrawal.
We may also decline enrolment, re-enrolment, or any future order at our discretion, and we may refuse to deal with anyone who has previously breached these terms.
Intellectual Property
All course materials, videos, meditations, workbooks, branding, and other content we provide are owned by us or our licensors. When you purchase a Service you receive a personal, non-transferable licence to use the materials for your own learning, for as long as your access to that Service lasts. You may not copy, share, resell, teach from, or create derivative works from our materials without our prior written consent. We may end the access of anyone who breaches this section, without refund. You acknowledge that misuse of our materials or confidential community content would cause us harm that damages alone cannot fully repair, and that we are entitled to seek injunctive or other urgent relief to stop it, in addition to any other remedy.
You keep the rights to anything you create and submit through the Site or our communities. By posting material in our spaces, you grant us a non-exclusive licence to host and display it as part of operating the Service. You are responsible for ensuring anything you post does not infringe the rights of others.
Limitation of Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from your use of the Site or Services, including loss of revenue, anticipated profits, business, goodwill, or data, or for events outside our reasonable control such as outages, viruses, or third-party attacks. Where liability cannot be excluded, our total cumulative liability to you is limited to the amount you paid us for the Service concerned (or NZD $100 if you have not made a purchase), except where the law does not allow that limitation.
This section does not limit any consumer rights described under “Cancellations, Refunds and Chargebacks” above, and nothing in these terms excludes liability that cannot lawfully be excluded.
Indemnity. You agree to indemnify us against losses, damages, and reasonable costs (including legal fees) arising from your breach of these Terms and Conditions or your unlawful use of the Site or Services.
Events beyond our control. We are not in breach of these terms, and are not liable to you, for delay or failure to deliver a Service caused by events beyond our reasonable control, including illness, natural disaster, epidemic, war, internet or platform outages, or the acts of third-party providers. Where such an event materially affects a live programme, we will reschedule the affected sessions or provide an equivalent alternative.
Time for claims. To the extent the law allows, any claim arising out of these terms or a Service must be brought within 12 months of the date you became aware (or reasonably should have become aware) of the facts giving rise to it. This does not shorten any period you are entitled to under applicable consumer law.
Dispute Resolution and Confidentiality
If something goes wrong, talk to us first. Almost everything can be resolved directly. You agree to raise any dispute with us in writing and give us 30 days to work with you in good faith to resolve it before starting any formal proceeding.
If we cannot resolve it directly, both parties agree to attempt mediation before litigation: a mediator agreed by both parties (or, failing agreement, appointed by the Resolution Institute of New Zealand), conducted remotely or in New Zealand, with the mediator’s costs shared equally.
Both parties agree to keep the existence and content of any dispute, negotiation, mediation, and settlement confidential, except where disclosure is required by law, to professional advisers, or to enforce an outcome. Nothing in this section prevents either party from seeking urgent injunctive relief from a court, reporting unlawful conduct to authorities, or, if you are a consumer, exercising rights under applicable consumer law, including through your local disputes tribunal or consumer protection agency.
Governing Law and General
These Terms and Conditions are governed by the laws of New Zealand, and you submit to the non-exclusive jurisdiction of the New Zealand courts, except that if you are a consumer in another country, this does not deprive you of protections you are entitled to under the mandatory laws of that country.
If any provision of these terms is held invalid, the remainder continues in full force, and the invalid provision is to be read down to the minimum extent necessary rather than struck out entirely where the law allows. No waiver of any provision is effective unless in writing. You may not assign or transfer your rights under these terms; we may assign ours as part of a genuine business transfer. Headings are for convenience only.
These terms, together with the specific offer page for a Service you purchase, are the entire agreement between us and supersede prior versions. In enrolling, you confirm you are relying on the written description of the Service on its offer page, not on any other statement, social media post, or informal remark. We may give you notices by email to the address on your account, and such notice is effective when sent.
We may update these Terms and Conditions from time to time. The current version, with its effective date, will always be posted on this page, and changes apply from the date they are posted. Material changes affecting current members or students will be notified by email or in the member portal.
